On Demand Services : Terms of Agreement

 

1. Our Standard

Brand Crush Monday will provide the services identified in the proposal or statement of work. Designer will provide these services in a professional manner, and in accordance to applicable professional standards.

 

2.    Payment Schedule

1 payment in full is due at the start of the project.

Client has the right to cancel services at anytime, however the deposit and any cost associated with the project is non-refundable. Upon cancellation all rights to the website revert to the designer and all original art must be returned, including sketches, comps, or other preliminary materials.

3. Dispute Resolution

If a dispute arises out of this Agreement that cannot be resolved by mutual consent, the Client and Designer agree to attempt to mediate in good faith for up to 30 days after notice given. If the dispute is not resolved, and in the event of legal action, the prevailing party shall be entitled to recover attorney’s fees and court costs from the other party.

4.    Permissions and Releases 

The Client agrees to hold the designer harmless against any and all claims, costs, and expenses, including attorney's fees, due to materials included in the Design at the request of the Client for which no copyright permission or privacy release was requested, or for which uses exceed the uses allowed pursuant to a permission or release.
 

 

5. All Content (NO EXCEPTIONS):

Client is responsible for delivering all requested content pertaining to all projects via email. Content should be written and attached to an email only.

Requested content should be sent to us as soon as possible

After 30 days, if website check list is not returned to BCM, you will forfeit your project and we will not be able to move forward.
 

Binding 

​This Agreement shall be binding at the time of checkout upon the parties hereto and their respective successors and permissible assigns.
